General provisions
Article 1 This insurance contract is consisted of insurance clauses, insurance application, insurance policy, certificate of insurance and endorsement on policy. Any agreements involving this insurance contract should be in writing.
Article 2 Such carrier registered in China as is engaged in the carriage of goods shall be deemed as the insured party to this insurance contract.
Insurance liability
Article 3 During the insurance period or such retroactive period as defined in the insurance contract, in the event the insured as mentioned above are engaged in the carriage of goods within the territory of the People’s Republic of China (not including HK, Macao and Taiwan), regarding such goods as are carried by the insured by way of the vehicles which are owned by the insured or leased under the contract to which the insured is a party, during the effective period of this insurance policy, any liabilities incurred by the insured for the owner of goods or carrier due to the damage to or loss of such goods during the transportation, according to the laws of the People’s Republic of China (excluding the laws of HK, Macao and Taiwan), shall be undertaken by the insurance company.
Exemption of liabilities
Article 4 In case of any one of the following circumstances, the insurer shall not be liable:
(1) Any losses are caused owing to the intentional act or gross negligence of the insured or its employees (including those arising from the theft and drunken driving).
(2) The carrier could prove that the damage to and loss of goods are resulted from the force majeure, natural character and reasonable allowances of such goods as well as the faults of the carrier and consignee.
Article 5 As the losses, fees and liabilities resulting from one of the following reasons, the insurer shall not be liable:
(1) Any liabilities arising from any consequences which are, directly or indirectly brought about by the war, similar act of war, hostile act, armed conflict, terrorism, rebellion and coup;
(2) Any liabilities which are, directly or indirectly, incurred by the strike, riot and civil unrest.
(3) Such losses as are caused by the nuclear reaction, nuclear radiation and radioactive contamination.
(4) All of the other consequences and losses arising from the loss of, damage to or delayed delivery of such goods.
